circumstance. the festivities and ceremonies don't begin for another three hours and tens of thousands of people are filing in. everyone here wanting to be a part of the inauguration of this president. president obama will take the oath of office today on the steps of the u.s. capitol. as many as 700,000 people are expected to fill the nationallal to watch. >> if anybody has tickets give me shout out. >> reporter: darrell came here in jackson mississippi and camped o out overnight hoping to get a good spot. thousands of law enforcement officers and federal troops from around the country will be on hand to make sure everyone is safe. >> today's swearing in on the steps of the u.s. capitol is ceremonial, held for the public. the constitution requires that the official swearing in take place on january 20th. >> i barack obama do solemnly swear. >> reporter: the president was officially sworn into office yesterday in a small ceremony at the white house. he followed that up with a

candlelight ceremony sunday night where he said today's parties are not about him. >> what we're celebrating is not the election or swearing in of a president. what we're doing is celebrating each other. >> reporter: and he talked about what he called the most significant event of the inaugural weekend, his wife's new haircut. >> i love her bangs. she looks good. >> reporter: the celebrations won't end until late monday night when they attend three different inaugural balls. >> among all the events happening today is fabulous entertainment. beyonce will sing the national anthem and kelly clarkson, my country tis of thee. >> susan live in washington d. c., thank you so much. and cbs 5 will have reports from our very own christin

enough to mix the summary and keep the temperatures warmer. 67 degrees in morgan hill. 66 in couperrer tee know and 66 in -- kupertino. should be a gorgeous day. 64 in hayward, and when might we see rain. talk about that more in a moment. we'll check out the roads with elizabeth. and this monday is a holiday monday. not as much traffic on the roads. we are seeing a few accidents. first i want to show this live look toward the dublin interchange, drive time is 15 minutes. elsewhere we sent our photographer down to san jose this morning. that is live look at 101 near mce key. -- mckee. and headlights and taillights. these are the accidents we're watching, northbound 680, ambulance chp both on scene

apparently everything is off right shoulder. the not much of a day heading through the entire dublin interchange. and this is a traffic alert in effect. it's pretty far south. we want to mention it because all lanes are blocked and southbound 101 approaching highway 156, a pretty bad accident involving a big rig and that traffic alert has been in effect for some time now. no estimates time when they're going to be able to reopen lanes. that's a check of traffic, back to you guys. and our other big story today, the 49ers are super bowl bound in a couple weeks. a huge come from behind winner. cbs 5 cate cauguiran is here in the city where the celebration still going on, although i think it's probably petering out a little bit at this hour. >> reporter: you can rest assured when people wake up it's going to continue. that count down to new orleans is on. and the big easy may know how to throw a party. i don't think any of the parties could rival the spirit

and celebration. the 49ers got back home into town just last night. here they are arriving into san jose's airport. and by the time they got back into the bay area, celebrations were in full swing. >> you can see clouds flooded the sidewalks, streets and bars. people were delirious with joy and within minutes of that win, super bowl t-shirts were out on the streets and some were going for 20 bucks a pop. >> we got it. we're going to the super bowl and the stingiest defense in the nfl, the smith wrecking company. >> reporter: throughout the city san francisco police were keeping a close eye on public drinking. officers made sure they confiscated any liquor in the open but they say they only had maybe a handful of arrests. i'm sure frank knows a little bit about this. san francisco is trying to be that first market to win both the world series and the super

under construction in santa clara. that's scheduled to open in 204. and it was a real come from behind effort for the 49ers. down 17-0 in the first half. >> they were, but back they come. storming back. we'll go to the 4th quarter and frank gore scored the 2nd touchdown of the game. what a big win. the 9ers had their first lead of the game, and shut out the falcons in the second half big time. that was your ball game. the 49ers are off to the big show, the super bowl and cbs 5 cbs 5 sports bern glen has more from georgia. >> welcome to the georgia dome here in atlanta. not quite super bowl hangover yet but the fnc championship hangover will have to do for the scarlet and gold. >> you know your coach got criticism when he switched to you. do you feel like you're justifying it with this and every game. >> i'm thankful he made that

decision. >> he played great. he played great. i don't have any other words to say it. i mean, it was a great performance. >> reporter: it was the biggest come back in the history of nfc championship game. the 49ers spotted him 17 points. and got it done. they earned a right to sleep in late today. i think we'll all let that go. >> vern glenn, cbs 5. vern is right. there was some violence following the 9ers falcons game. a fan was stabbed during a fight outside the georgia dome in atlanta. investigators say an atlanta fan punched a 9ers fan and he stabbed him in the neck. his condition is not known at this time. no word on any arrests. and now we know 9ers coach jim harbaugh will be meeting his own brother in the super bowl. tom brady and the favored new

england patriots had to go through head coach john harbaugh and the baltimore rapes to get there. it was a -- ravens to get there. ultimately they beat new england 28-13. and you can watch the 49ers play the baltimore ravens in the super bowl right here on cbs 5. remember, it's just two weeks from yesterday, sunday it's february 3rd in new orleans. kick off is at 3:30 and the the week leading up to the super bowl we're going to have a team of reporters in the big easy covering the 9ers and of course the bay area fans making their way down there. that coverage begins a week from tonight. >> you are a patriots fan, but you said the right teams are in the super bowl and of course you love the 49ers. >> i grew up here and my heart is here. and i had lots of fans texting me, they hate the ravens and love the 9ers. repairs begin on a bay bridge following the tanker scrape. >> the hefty price tag and how long it will take. and to honor martin luther

surfers went head to head yesterda right here in the bay area was the mavericks surfing invitational. two dozens of the world's best surfers went head to head. viewing was restricted to a hotel parking lot when authorities closed the beach and bluffs when spectators were almost washed out to sea two years ago. >> that is exactly what they would expect californians to do, spend the sunday afternoon watching the surfing on a big screen in the middle of the parking lot. >> fans were not disappointing getting a close up experience of what it's like to surf the big waves. the crowd was smaller than last year but still drew 30,000 people. and the bay area came up big in the competition, the winner 43-year-old peter mel followed up by zach of san francisco and greg long of san clemente. >> i think your house is safe.

>> i was watching the 49ers. >> of course you were. >> i was actually watching the 49ers. let's talk about traffic. hopefully you recovered after the big events this weekend. maybe you have today off. if you do have to work. traffic is pretty light. we are following a couple of problem spots,ing inning one northbound 288 on the connector ramp to northbound 880. there is an accident there. we thought it was cleared but now emergency crews are on scene. the fire truck is actually blocking the lane. you can see a little bit of slowing as you make your way northbound on 288. just a heads up, it's not a typical commute day by any stretch. you can see there's more space in between cars this morning up and down the nimitz freeway between downtown oakland into hayward. oakland airport, no delay getting there. another accident on 880, northbound 880 approaching mallory. there's an accident reported.

big changes ahead. maybe with some rain we turn into the forecast as early as wednesday. out over the bay, nice and clear. 29 degrees in concord. 29 in santa rosa. 42 in san francisco. and 42 and freezing in livermore. this dome of high pressure that's been sitting overhead now beginning to shift a little further to the east. eventually that breaks down and that means, well, a chance of rainmaking a return to the bay area. before today, it should stay nice and dry and warm. how about 72 degrees in the monterey bay. 67 in fresno. and 52 degrees in lake tahoe. the future cast model showing the skies staying clear through the day. and overnight tonight in toward tomorrow morning. otherwise we'll keep the skies nice and clear and bright. looking good temperature wise. numbers running up to 67 degrees in morgan hill and 65 in milpitas. east bay, in the 60s in many spots and inside the bay, mid-

60s in oakland. 63 in san francisco and 65 degrees in santa rosa. next couple of days very nice and spring like. by wednesday there is a chance of showers making a return to the bay area. that will likely open the door to possibilities of more showers this coming weekend. >> i guess we were due. >> it's been a long dry spell. we're going to get back into winter. >> thanks so much. a freedom train to celebrate the birthday of martin luther king travels from san jose to san francisco in just a few hours. >> it is a way to educate the young about the past civil rights strag rights -- struggles. and elissa harrington is there with more about how they can learn to ride the ride. >> reporter: this freedom train is to honor the birthday of martin luther king and leaves the station at 9:30. this is the 27th year that the mlk association of santa clara valley has organized this ride from san jose to san francisco.

it commemorates his march from selma alabama to the dap toll of montgomery in 1965 and covers 54 miles. this is the longest running freedom train in the united states and the rides were brought about my king's wife. the freedom train today has four stops. again, it will leave san jose at 9:30 and will stop three times along the peninsula in sunnyvale, palo alto and san mateo. round trip tickets are $10 you are advised to come early because lines can get long. live in san jose, elissa harrington. cbs 5. a march and parade will proceed from the caltrains depot. that will be followed by an interface commemoration ceremony. and also in san francisco there is a labor breakfast at 8:00 a.m. at the west bay conference center and people in the bay view hunters point are invited to the ruth williams memorial

theater for historical footage. here's a run down, all the government offices are shut downn't on the federal, county and industry level as well. that includes courts and the post office. all banks, savings institutions, they are closed. b.a.r.t. and muni are on a saturday schedule today and golden gate ferry are on a modified holiday schedule and ac transit on a sunday schedule. the gun buy back program is a victim of its own success. when weapons are turned in today, vouchers will be handed out instead of money. all the money was used last week when 827 weapons were given up. the buy back today is at police stations in sandra san -- san rafael. and hours are eleven this morning until 8 tonight. other headlines around the bay, san leandro police are looking for three suspects in fatal shooting at the bay fair

b.a.r.t. station a. 50-year-old man was killed and a woman was wounded after police say they were caught in the cross fire of two rival groups on saturday. one person is in custody. in san francisco, a fire left two adults and two children without a home. it broke out in a second story unit late yesterday afternoon. no one was injured. it is 5:21 now. he helped the 9ers rush all the way to the super bowl. coming up next, our play of the day. plus, it wasn't all 9ers, hockey fans packed shark bay bars ass sharks took to the ice. we have all the game highlights.

up from the roof at the high school. dozens of firefighters are battling the large fire and apparently it broke out in the cafeteria just before 2:30 this morning. >> and part of the building apparently has collapsed. school of course not in session today because of the holiday. the martin luther king holiday. the cause of the fire is not known. as you can e see. it's fully engulfed. the a number of apps there. nownow onto hockey. the sharks opening game is a preview of the rest of the season, it was well worth the wait. >> they played won. pat trick marlow had two goals and they beat the flames on the run in their opener. they play edmondson tomorrow and get to come home thursday against the phoenix coyotes out of the shoot looking good for san jose. play of the day, frank

national mall to witness the second oath of office. chief justice john roberts officially administered the oath to the president yesterday during a brief ceremony in the blue room in the white house. it was followed by another small ceremony last night. >> what we're celebrating is not the election or swearing in of a president. what we're doing is celebrating each other. >> vice president biden took the official oath yesterday. it was administered by supreme court justice sanya so tommy your . according to tradition, if the 20th falls on a sunday, a public swearing in and most festivities take place on the 21 21st. and today's events are taking on special significance on this martin luther king holiday. >> reporter: when president

obama is publicly sworn into office today it will be before a crowd roughly half the size of the one that jammed his 2009 inauguration. >> i barack obama hussein obama do solemnly swear. >> reporter: but it will have its own historical distinction. it will happen on the national mall where 50 years ago martin luther king junior gave his speech here, a serendipity not lost on bay area people we tracked down. >> anybody from california. >> i used to be from california. >> reporter: this summer san francisco man believes it's a perfect storm. >> to have everything happening, you know, right now with the 50 50th anniversary of dr. king's speech with the 150th 150th anniversary of the emancipation proclamation, it's amazing. i think it's great. >> i find it so fitting for the second inauguration of this administration and for what our country needs today. >> this is history. it will always be in the

after waiting outside in the gates outside of the mall for about three hours this morning and i have to tell you it was quite chilly out here, below freezing temperatures and waiting for about 3, 3 1/2 hours to get through. we were originally supposed to go through with the media but there was something of a delay and wound up waiting around with the general public and we're here now, and at the moment, set back quite a ways from the center stage of where barack obama will make his public oath. but again, we're amongst about what is estimated to be about 700,000 people. the preparations have been underway for quite some time now, and in the mall you can look around and see people in every direction. there's also a maze of thousands and thousands of security officials around and really just kind of an atmosphere that is certainly

celebratory and pretty calm. >> four years ago, it was pretty calm and you mention that i had expect half the people -- mentioned that they expect half the people than last time he was inaugurated but as you said they're still stepping up security in the area. >> that's correct. we are seeing very strong security of every kind, everything from u.s. police to officers and what appears to be national guard. certainly a military presence and secret service presence out here as well. again, we are definitely expecting those numbers, anywhere from 700,000 to 800,000 people expected to converge on the national mall today and that is actually less than half of what the number of people who showed up to the 2009 inauguration. i believe the count at that time was something closer to 1.2 million or something like that. so it's definitely a smaller crowd, and from what i can see, a celebratory, but something of

preamped because of the live coverage. apparently lawrence didn't get the word from the president. he wanted 50 degrees in the nation's capitol. it sounds pretty cold out there. >> we don't have a noon newscast? >> no. we'll have to figure out something else to do. >> i'm sure there are a few things. by the way, you see this, we are getting ready for the super bowl at cbs 5. that's where the bowl is at this year. >> folks from around the bay area, we have a lot of sunshine. a cold start to again in some of the eves. you have most -- valleys. you have mostly clear skies but the clouds are creeping every close to the coastline, and the ridge of high pressure showing signs of weakening but not before a great day today. temperatures outside, 27 in fairfield, 32 right at the freezing mark in livermore and bit afternoon, we're enjoining sunshine and well into the 60s, almost 70 degrees. and up in low to mid-60s in

most spots and inside the bay we'll find hazy sunshine. let's check out the roads with elizabeth. we're following a couple of traffic alerts, including one in the east bay. it's in alameda county. northbound 880 approaching washington sheet before we thought it was on the connector ramp from 238 to 880. it sounds like the main lines of the freeway. there is that far lane blocked speeds are slow approaching washington. 33 miles per hour. they're working to clear it. there may be trees down in the roadway as well. once you get past washington, everything looks good up and through oakland, down. this is the other traffic alert, south of gill roy, a big rig jackknifed and approaching 101. that's traffic. back to. you there is another big story this morning. the 49ers have one more game this season, and that of course

is the super bowl. cate cauguiran here in san francisco as fan's celebrate the championship. this place was rocking last night. >> reporter: this is the rest they're going to get before the celebration continues because our eyes now are on that 6th 6th super bowl win. well, last night our team arrived back in the bay landing the at san jose's airport, coming back, celebrating and bleeding that red and gold. crowds spilled out into the streets, the cheers and chants could be heard throughout the city and didn't take long for the super bowl t-shirts to hit the street as well. one guy was selling them for 20 bucks a pop. >> we're going to the super bowl. and the stingiest defense in the nfl, smith wrecking company. >> reporter: police did keep a close eye on fans and public drinking. officers at times confiscated

any liquor consumed out in the open but only made a handful of arrests last night. we want to make note, this is an exciting time, the first time the 9ers have played in the super bowl since 1995. it's one more game but the big game. cate cauguiran cbs 5. >> it was an exciting game to watch yesterday. it really was. >> it was kind of a white nubbing already to start. >> it was a real come from behind effort. they were down 17-0 in the first half. >> they were but no one lost faith because they came storming back. frank gore had a big game, a couple of touchdowns and finally second td and after being down that 7-0, 49ers on top and the the defense kind of shut them down. the falcons had a chance in the remaining seconds and couldn't do it. that's your ball game. 9ers win. >> the best day of my life was when my kids game. this is one of them.

california.. here's a live look right now doze we got an update on breaking news out of southern california. right now dozens of firefighters all battling a large fire at mountain view high school in el monte california. it broke out in the cafeteria building just before 2:30 this morning. part of the building has collapsed. you can see a lot of fire trucks on hand, a number of hoses still trying to get the flames under control. school is not in session today due to the martin luther king holiday. the cause of the fire still not known. they have a lot of work to do down there. we'll you updated. the site of a deadly hostage crisis, algeria. islamist militants planted explosive traps there. authorities now say at least 81 people were killed including 32
